This Offer from the operator of the website https://bastionvpn.net/, hereinafter referred to as the "Operator", addressed to the user of the website, hereinafter referred to as the "User", is an offer to enter into a license agreement regarding the right to use the BastionVPN software product and defines the basic terms for using the said software product through the website available at https://bastionvpn.net/. The User, acting to obtain the right to use the BastionVPN software product, accepts the terms of this Public Offer on the following conditions.

1.1. Public Offer (the "Offer") means the Operator's public proposal, addressed to an indefinite number of persons, to enter into a license agreement with the Operator remotely (the "Agreement") on the terms contained in this Offer, including all appendices.

1.2. License means the scope of permitted methods and term of use of the BastionVPN software product granted to the User based on the selected tariff and its payment. Payment for the License constitutes the User's full and unconditional acceptance of this Offer.

1.3. Tariffs mean the pricing system for the License.

1.4. User means an individual who has expressed agreement with the terms of this Offer and is interested in obtaining the right to use the BastionVPN software product on the terms set out in this Offer.

2.1. The Operator grants the User a non-exclusive right to use the software product under the terms of the specific License described in the Tariffs, for a fee paid by the User through the payment methods available on the website https://bastionvpn.net/. Payment for the License confirms the User's consent to conclude this Agreement (acceptance of the offer).

2.2. By concluding the Agreement, the User confirms the following:

• a) the User has fully read and agrees to the terms of the Offer;
• b) the User gives consent to the collection, processing, and transfer of personal data in accordance with the Privacy Policy published on the website https://bastionvpn.net/.

2.3. The provisions of the Offer apply to the relationship between the Operator and the User from the moment the User starts using the website and pays for the License. The Operator may amend this Public Offer unilaterally at any time without prior approval from the User. New terms for previously concluded agreements with the User take effect from the moment the User pays for a new License, including when such payment is made through the recurring payment system.

2.4. The Operator may also unilaterally change the scope of rights and methods of use of the BastionVPN software product provided under a specific License and Tariff. For a User who has already paid for the relevant License, such changes take effect only from the moment the User pays for a new License, including when such payment is made through the recurring payment system.

3.1. The amount of the license fee for the right to use the BastionVPN software product is stated on the website https://bastionvpn.net/ in the Pricing section.

3.2. The Operator may unilaterally change the amount of the license fee specified in the Tariffs for any tariff.

3.3. The Operator may not change the amount of the license fee for a License that has already been paid for. After the current License expires, the User must pay the license fee in force on the date of payment in order to continue using the License for a new term.

3.4. The User's obligation to pay for the License is deemed fulfilled from the moment the Operator receives the funds in full in accordance with the Tariffs.

3.5. Settlements between the Operator and the User for payment of the license fee for the right to use the BastionVPN software product are made using the methods indicated on the website https://bastionvpn.net/.

3.6. By paying for the License, the User also confirms that they have read the Agreement on joining the recurring payment system and consents to payment of the license fee for the right to use the BastionVPN software product by automatic debiting of funds from the User's bank card in favor of the Operator.

4.1. The User selects a suitable License through the website https://bastionvpn.net/ or by receiving an invoice sent to the client's email address.

4.2. When selecting a suitable License on the website https://bastionvpn.net/, the User agrees to provide an email address.

4.3. If the Operator requires additional information, it may request it from the User. If the User does not provide the required information, the Operator is not liable for any delay in granting the License or for the User's inability to use the License.

4.4. The User is responsible for the accuracy of the information provided when the License is issued.

4.5. The Agreement between the Operator and the User is deemed concluded from the moment the User pays the license fee for the License selected by the User.

4.6. If the User does not use the "Cancel Subscription" form on the website https://bastionvpn.net/, the term of the License issued to the User is extended for the same period after expiration of the initial License term on the terms specified in the Pricing section of the website https://bastionvpn.net/ as of the date of such extension (automatic renewal of the License).

5.1. The License includes a defined scope of rights and methods of using the BastionVPN software product that the User may use for a certain period.

5.2. The License is deemed granted to the User for the term specified in the License from the moment the User pays the license fee for that License, as confirmed by the data in the User's personal account on the website.

5.3. From the moment specified in clause 5.2, the User may use the BastionVPN software product through the personal account.

6.1. The User may refuse the License at any time during the term of the Agreement. The license fee paid in accordance with the Tariffs is non-refundable. In this case, the date of termination of the Agreement is the expiration date of the paid License.

6.2. If the User does not contact the Operator in writing using the addresses specified on the website https://bastionvpn.net/ with a proposal to terminate the Agreement, the Agreement remains in force until it is terminated by agreement of the Parties.

6.3. The Operator may restrict the User's right to use the BastionVPN software product in the ways provided by the License if it detects bad-faith use of the BastionVPN software product, namely:

• a) use of the BastionVPN software product by the User for the purpose of violating the legislation of the Russian Federation or the legislation of other states;
• b) transfer of the individual access key, including authentication data for access to the personal account on the website, to third parties, except for the User's close relatives;
• c) exceeding the traffic quota used within the BastionVPN software product in the amount of 500 gigabytes over 30 days. If this threshold is exceeded, the right to use the BastionVPN software product will be suspended automatically. In that case, the User may contact the Operator through any available communication channel and request an increase of the traffic limit. In response to such a request, the Operator must increase the User's traffic limit to 1 terabyte for the duration of the current paid License no more than once every 30 days.

7.1. The User agrees not to use the BastionVPN software product for sending spam, scanning ports and proxies, conducting mass mailings, even if the emails are actually sent through another server, and not to carry out hacking attacks on other computers or networks.

7.2. Coverage area, internet speed, and connection quality when using the BastionVPN software product may vary. The Operator undertakes to do everything possible to ensure that the BastionVPN software product is available at all times, except for maintenance and repair breaks. Use of the BastionVPN software product within the paid License may be unavailable due to factors beyond the Operator's control, including emergencies, network problems or restrictions, interference, signal interruption, or disruptions in other services.

7.3. The Operator is not liable for loss of data or messages or for incorrect page rendering caused by network problems, for example on a T-1 line. To protect Users, the Operator may unilaterally set restrictions on the use of certain data and block servicing of clients. Network speed is a nominal estimated characteristic and does not correspond to the actual speed of sending and receiving data. Actual network speed depends on its configuration, the method of data compression, network load, and other factors. The Operator makes no guarantees regarding the timeliness of data delivery and is not liable for possible delays or losses.
